General Terms and Conditions for End Customers

1. Scope of application
The following General Terms and Conditions of El Puente GmbH in Nordstemmen apply exclusively to all orders placed by consumers via our online shop. following General Terms and Conditions of El Puente GmbH in Nordstemmen.
2. Contracting party, conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the order button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of the order together with its acceptance shall be sent immediately by an automated e-mail. With this e-mail confirmation, the purchase contract is concluded.
By placing your order, you accept these General Terms and Conditions.

We do not store the text of the contract. It is therefore not possible for you to access the contract text after conclusion of the contract.

6. Shipping costs
For parcel deliveries within the Federal Republic of Germany, shipping costs of € 6.90 gross are added to the stated product prices. From a gross order value of € 50.00 and more, delivery in Germany is free of shipping costs.
For parcel deliveries within the European Union, shipping costs of € 12.90 or 14.90 gross are added.
7. Payment
The following payment methods are available in our shop:
Prepayment
If you choose payment in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.
Paypal
You pay the invoice amount via the online payment service provider Paypal. You must be registered there or register first, legitimise yourself with your access data and confirm the payment order to us (exception: guest access). You will receive further instructions during the ordering process.
VISA, mastercard
You pay the invoice amount with your VISA or Mastercard card via the online payment service provider Payone. You must have a personally valid VISA card and a sufficient credit limit. To do this, enter your details, follow the payment instructions and confirm the payment (except for guest access, if applicable). You will receive further instructions during the ordering process.
giropay pay direct
You pay the invoice amount via the online provider Payone using giropay pay direct. You must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us (exception: guest access). You will receive further instructions during the ordering process.
klarna
You pay the invoice amount via the online provider Payone using klarna. You must always be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us (exception: guest access). You will receive further information during the ordering process
giropay
You pay the invoice amount via the online provider Payone using giropay. You must always be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us (exception: guest access). You will receive further instructions during the ordering process.
8. Self-collection
You have the option of picking up your order at El Puente GmbH, Lise-Meitner-Str. 9, 31171 Nordstemmen, Germany, during the following business hours:
Monday to Friday 9:00 - 13:00 and 13:45 - 16:00, except on public holidays or during company holidays. Please inform us at least two working days before your collection so that we can provide the goods from our warehouse. Payment by EC card is possible on site.
9. Retention of title
The goods remain our property until full payment has been made.
10. Set-off
Offsetting against our claims is only permitted with undisputed or legally established counterclaims.
11. Claims for defects and damages
Claims for damages against us due to defects or other breaches of duty are excluded. This exclusion of liability does not apply to claims for damages for injury to life, limb or health and for damages based on an intentional or grossly negligent breach of duty or on the breach of an essential contractual obligation. Material contractual obligations are obligations which make the proper performance of the contract possible in the first place and on whose compliance the contractual partner may rely or whose non-performance endangers the purpose of the contract. If an essential contractual obligation is breached due to slight negligence, our liability shall be limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract. The aforementioned provisions shall also apply to claims for damages arising from tort and culpa in contrahendo. Any liability on our part in accordance with the provisions of the Product Liability Act remains unaffected.
In all other respects, your rights in the event of defects shall be governed by the statutory provisions.
12. Protection of minors
Certain articles in our product range belong exclusively in the hands of adults. We reserve the right to deliver such articles, which are specially marked in the product descriptions, only to natural persons of full age and unrestricted legal capacity and to demand appropriate proof of age. The data required for the order, such as name, address, etc., must be provided completely and truthfully.
13. Applicable law
In the case of contracts with a foreign connection, it is agreed that German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). However, German law shall not apply insofar as this deprives you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.
14. Consumer dispute resolution
The EU Commission has set up an internet platform for out-of-court online dispute resolution ("ODR platform"). The OS platform can be reached at https://ec.europa.eu/consumers/odr/
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
